These Terms of Service ("Terms") govern your use of the website and services offered by Being and Mind LLC ("we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms.
Being and Mind LLC offers:
You must be at least 18 years old to book services or use our website. Retreat participants must be at least 14 years old. Anyone under 18 must be accompanied by a parent or legal guardian for the duration of the retreat, and a parent or legal guardian must give written consent and sign the separate agreement we will provide for them. Being and Mind assesses each participant individually and may decline or withdraw a retreat booking for legitimate suitability or safety reasons. If we withdraw a booking you have already paid for, we will refund all payments.
Retreat registration is secured upon payment of a non-refundable deposit. Full payment schedules and deadlines are communicated during the booking process. All prices are listed in USD and are subject to change prior to booking confirmation. Payment is processed securely through our third-party payment provider.
If you have booked a retreat, your Participant Agreement and Booking Confirmation set out the terms that apply to your booking. The Agreement covers participation, risk, responsibility and disputes. The Confirmation covers your booked segment, dates, price, payments, cancellation and refunds. If anything in these Terms conflicts with those documents, those documents apply, subject to applicable law.
Every retreat participant must sign our Participant Agreement. We provide it, together with your Booking Confirmation, before your booking is confirmed. If you decline to sign, we cannot accept your booking, and the cancellation terms applying to your booking will apply.
If you cancel for personal reasons, you may apply for a 50% refund before the cancellation deadline specified for your retreat. No refunds are issued after the cancellation deadline. If Being and Mind cancels a retreat before it begins, including its first arranged group transfer, for any reason, including insufficient participants or unexpected circumstances, you will receive a full refund of all payments within 30 days. If a retreat is cut short after it has begun, we will refund what we can recover from our suppliers or have not already spent, less the reasonable costs of the interruption. There is no fixed refund per missed day. Specific cancellation deadlines and terms are provided during registration.
Participants in international retreats are solely responsible for:
Travel insurance is required for all international retreats. Your policy should cover emergency medical treatment, evacuation and repatriation, and trip cancellation and interruption. You choose your own policy. Being and Mind does not select, verify or guarantee your coverage.
Being and Mind LLC is not liable for travel disruptions, visa denials, changes in entry requirements, or conditions at the destination beyond our control.
Our services, including retreats, consultations, guides, and content, are for educational and wellness purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before beginning any new wellness practice, especially if you have existing health conditions.
We do not guarantee specific health outcomes. Individual results vary. Testimonials on our website represent individual experiences and should not be interpreted as promises or guarantees.
Participants are responsible for disclosing relevant health conditions prior to retreat participation or consultation, and for knowing their own physical limitations.
Participation in retreats and wellness activities involves inherent risks, including but not limited to physical activities (yoga, meditation, walking, outdoor excursions), international travel, dietary changes, and exposure to unfamiliar environments. By participating, you acknowledge and voluntarily assume these risks.
To the fullest extent permitted by law, Being and Mind LLC's total liability for any claim arising from our services is limited to the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages. Where you have accepted a Participant Agreement for a retreat, limits of liability are governed by that Agreement rather than this section.
Our retreats are filmed and photographed as a group for promotional purposes, and signing our Photo and Video Release is a condition of participation. We provide it with your Participant Agreement before your booking is confirmed. If you decline to sign, we cannot accept your booking, and the cancellation terms applying to your booking will apply. We may at our discretion agree alternative arrangements with you. Participants must respect others' privacy and follow venue photography rules.
All content on our website, including text, images, guides, and materials, is the property of Being and Mind LLC. You may download free guides for personal use only. No reproduction, distribution, or commercial use is permitted without written permission.
We expect respectful and considerate behavior from all participants. Being and Mind may remove a participant whose conduct seriously endangers or disrupts others, who participates unsafely, or who materially breaches the applicable Code of Conduct. Refund consequences are governed by the participant's Booking Confirmation and applicable law.
You agree to indemnify and hold harmless Being and Mind LLC, its founders, employees, and agents from any claims, damages, or expenses arising from your participation in our services, your conduct, or your violation of these Terms. Where you have accepted a Participant Agreement for a retreat, responsibility for third-party claims is governed by that Agreement, and nothing in this section enlarges it.
These Terms are governed by the laws of the State of North Carolina. Any disputes arising from these Terms or our services shall be resolved in the state courts of Buncombe County, North Carolina or, where federal subject-matter jurisdiction exists, the United States District Court for the Western District of North Carolina, Asheville Division.
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms. Your Booking Documents govern your booking and prevail over these Terms, including over any later version of them.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
